1. Acceptance of Terms
By accessing, browsing, or using ScamSearch ("the Platform," "the Website," "the Service"), you ("User," "you," or "your") agree to be legally bound by these Terms of Service and Legal Disclaimer ("Terms"). If you do not agree to all of these Terms, you must immediately cease using the Platform.
These Terms constitute a binding legal agreement between you and ScamSearch ("we," "us," "our," or "the Company"). Your use of the Platform constitutes your acceptance of these Terms.

ScamSearch is a passive hosting platform that allows users to submit reports about alleged scams. We operate as a neutral intermediary and do NOT:
- Verify, investigate, or authenticate any submitted reports
- Confirm the accuracy of any allegations or claims
- Endorse, adopt, or take responsibility for user-generated content
- Conduct background checks or investigations
- Provide legal, financial, or professional advice
- Exercise editorial control over submissions (except to remove prohibited content)
- Guarantee that any person or entity listed is actually a scammer
THE PRESENCE OF A REPORT ON THIS PLATFORM DOES NOT MEAN THE ALLEGATIONS ARE TRUE. Reports reflect only the subjective opinions and experiences of individual users.
3. Complete Disclaimer of Warranties
THE PLATFORM AND ALL CONTENT ARE PROVIDED "AS IS," "AS AVAILABLE," AND "WITH ALL FAULTS."
We make NO WARRANTIES, representations, or guarantees of any kind, whether express, implied, statutory, or otherwise, including but not limited to:
- Accuracy: We do not warrant that any content is accurate, complete, current, or reliable
- Merchantability: No warranty that the Platform is fit for any particular purpose
- Non-Infringement: No warranty that content does not violate third-party rights
- Availability: No guarantee that the Platform will be available, uninterrupted, or error-free
- Security: No guarantee against viruses, malware, or unauthorized access
- Results: No guarantee of any particular outcome from using the Platform
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED.
4. Complete Limitation of Liability
MAXIMUM LIABILITY PROTECTION:
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL SCAMSEARCH, ITS OWNERS, OPERATORS, DIRECTORS, EMPLOYEES, CONTRACTORS, AGENTS, AFFILIATES, LICENSORS, OR SERVICE PROVIDERS BE LIABLE FOR:
- Any direct, indirect, incidental, special, consequential, exemplary, or punitive damages
- Loss of profits, revenue, data, goodwill, or business opportunities
- Personal injury or property damage
- Emotional distress or reputational harm
- Defamation, libel, or slander claims arising from user content
- False accusations or mistaken identity claims
- Damages from reliance on any content on the Platform
- Unauthorized access to or use of your information
- Any conduct of third parties on the Platform
- Errors, omissions, or inaccuracies in content
- Temporary or permanent unavailability of the Platform
- Deletion, corruption, or failure to store any content
THIS LIMITATION APPLIES REGARDLESS OF:
- Whether we were advised of the possibility of such damages
- The legal theory (contract, tort, negligence, strict liability, or otherwise)
- Whether the claim is based on breach of warranty, failure of essential purpose, or otherwise
IF YOUR JURISDICTION DOES NOT ALLOW THE EXCLUSION OR LIMITATION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, OUR LIABILITY IN SUCH JURISDICTION SHALL BE LIMITED TO THE MAXIMUM EXTENT PERMITTED BY LAW. IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED $100 USD OR THE AMOUNT YOU PAID TO US IN THE PAST 12 MONTHS (IF ANY).
5. User Responsibilities & Obligations
By using the Platform, you agree to:
5.1 Truthfulness & Good Faith
- Submit only information you believe to be true and accurate based on your personal experience
- Not knowingly submit false, misleading, or defamatory content
- Act in good faith and not use the Platform for malicious purposes
- Include evidence and context to support your claims when possible
5.2 Prohibited Uses
You shall NOT:
- Submit false reports, fabricated evidence, or knowingly inaccurate information
- Use the Platform for harassment, bullying, doxxing, or personal vendettas
- Post content that is illegal, obscene, threatening, or violates third-party rights
- Disclose private information (addresses, social security numbers, credit card numbers, etc.)
- Impersonate any person or entity
- Upload viruses, malware, or malicious code
- Scrape, harvest, or collect user data without permission
- Attempt to hack, compromise, or disrupt the Platform
- Use automated tools (bots, scripts, crawlers) without authorization
- Submit spam, advertising, or commercial solicitations
- Violate any applicable laws or regulations
5.3 Legal Compliance
You are solely responsible for ensuring your submissions comply with all applicable laws, including but not limited to defamation laws, privacy laws, and intellectual property laws. You may be held criminally or civilly liable for submitting false reports or defamatory content.
6. Content Ownership & License
6.1 Your Content: You retain ownership of any content you submit. However, by submitting content to the Platform, you grant us a perpetual, irrevocable, worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to use, reproduce, distribute, display, perform, modify, and create derivative works from your content in connection with operating the Platform.
6.2 Waiver: You waive any moral rights or attribution rights in your submitted content to the extent permitted by law.
6.3 Representations: You represent and warrant that you own or have the necessary rights to submit your content and that it does not violate any third-party rights.
7. Indemnification
YOU AGREE TO INDEMNIFY:
You agree to defend, indemnify, and hold harmless ScamSearch and its owners, operators, directors, officers, employees, contractors, agents, affiliates, licensors, and service providers from and against any and all claims, damages, obligations, losses, liabilities, costs, debts, and expenses (including but not limited to reasonable attorneys' fees and court costs) arising from or related to:
- Your use or misuse of the Platform
- Any content you submit or post
- Your violation of these Terms
- Your violation of any third-party rights, including privacy, publicity, copyright, or other intellectual property rights
- Any defamation, libel, or slander claims arising from your submissions
- Your violation of any laws or regulations
- Any harm caused to other users or third parties
This indemnification obligation survives termination of your use of the Platform.
8. Content Moderation & Removal
8.1 Our Rights: We reserve the right (but have no obligation) to:
- Monitor, review, edit, or remove any content at our sole discretion
- Refuse or remove content that violates these Terms
- Suspend or terminate user accounts for violations
- Cooperate with law enforcement and legal requests
- Preserve content for legal purposes
8.2 No Obligation: We are NOT obligated to monitor, pre-screen, or review content before it is posted. We act as a passive conduit for user content under Section 230 of the Communications Decency Act.
8.3 Removal Requests: To request removal of content, see our Dispute Resolution page. We will review requests in good faith but reserve the right to make final decisions.
9. Section 230 Protection
ScamSearch operates as an interactive computer service under the Communications Decency Act, 47 U.S.C. § 230. We are not the publisher or speaker of user-generated content and shall not be treated as the publisher or speaker of any information provided by users. We retain all protections and immunities afforded under Section 230.
10. DMCA & Copyright
10.1 Copyright Policy: We respect intellectual property rights. If you believe content on the Platform infringes your copyright, send a DMCA notice to legal@scamsearch.org including:
- Identification of the copyrighted work claimed to be infringed
- Identification of the material claimed to be infringing and its location
- Your contact information (address, telephone, email)
- A statement that you have a good faith belief that use is not authorized
- A statement that the information is accurate and, under penalty of perjury, that you are authorized to act
- Your physical or electronic signature
10.2 Counter-Notice: If you believe content was wrongly removed, you may file a counter-notice.
10.3 Repeat Infringers: We may terminate accounts of repeat copyright infringers.
11. User Conduct Standards
Additional conduct requirements:
- Accuracy: Make reasonable efforts to ensure accuracy of your reports
- Evidence: Provide evidence when available (screenshots, transaction records, etc.)
- Context: Include relevant details and context
- Updates: Update or correct reports if circumstances change
- Objectivity: Be as objective as possible; avoid inflammatory language
- Privacy: Respect privacy; don't share unnecessary personal information
- Civility: Interact respectfully with other users and reported parties
12. Third-Party Links & Services
The Platform may contain links to third-party websites, services, or resources. We:
- Do not control, endorse, or assume responsibility for third-party content
- Make no warranties about the safety, accuracy, or legality of third-party sites
- Are not liable for any harm or damages related to third-party services
- Recommend reviewing the terms and privacy policies of any third-party sites you visit
13. Privacy & Data
Your use of the Platform is also governed by our Privacy Policy. Key points:
- We may collect and process your data as described in the Privacy Policy
- Submitted reports may be public and permanently archived
- We may retain content even after removal for legal and safety purposes
- We may share information pursuant to legal obligations or to protect our rights
14. Dispute Resolution & Arbitration
14.1 Informal Resolution: Before filing any claim, you agree to contact us at legal@scamsearch.org to attempt to resolve the dispute informally.
14.2 Binding Arbitration: Any dispute not resolved informally shall be resolved through binding arbitration in accordance with the American Arbitration Association rules, rather than in court, except where prohibited by law.
14.3 Class Action Waiver: You agree to bring claims only in your individual capacity and not as part of any class, collective, or representative action.
14.4 Jurisdiction: If arbitration is not permitted, disputes shall be resolved in courts located in [Your Jurisdiction], and you consent to personal jurisdiction there.
15. Governing Law
These Terms shall be governed by and construed in accordance with the laws of [Your Jurisdiction], without regard to its conflict of law principles. The United Nations Convention on Contracts for the International Sale of Goods shall not apply.

We reserve the right to modify these Terms at any time at our sole discretion. Changes will be effective immediately upon posting to the Platform. Your continued use of the Platform after changes constitutes acceptance of the modified Terms. We encourage you to review these Terms periodically.
If you do not agree to modified Terms, you must stop using the Platform immediately.
19. No Waiver
Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision. No waiver shall be effective unless in writing and signed by an authorized representative.
20. Assignment
You may not assign or transfer these Terms or your rights hereunder without our prior written consent. We may assign these Terms without restriction. These Terms shall be binding upon permitted successors and assigns.

- You use the Platform entirely at your own risk
- ScamSearch has no liability for any damages arising from your use
- You are responsible for all content you submit
- You may be held liable for false or defamatory submissions
- These Terms limit your legal rights and remedies
If you do not agree with any part of these Terms, you must not use the Platform.
